Since learned counsel for the applicant was absent in the first session, matter was kept back. Even on second call, none present for the applicant.

Learned APP on instructions of the Investigating Officer submits that the Trial Court has examined 21 witnesses and endeavour will be made to conclude the examination of witnesses. 3.

Perusal of the record indicates that the applicant is arraigned as accused for a serious offence and the provisions of The Maharashtra Control of Organised Crime Act, 1999 are levelled Iresh 1 of

3-BA-3589-2025 (CR).doc against him. There are also several cases pending against the applicant and the trial is in progress.

The Hon'ble Apex Court in the case of X Versus State of Rajasthan and Anr (2024 INSC 909), wherein the Hon'ble Apex Court has observed as under:

"14. Ordinarily in serious offences like rape, murder, dacoity etc. once the trial commences and the prosecution starts examining its witnesses, the Court be it the Trial Court or High Court should be loath in entertaining the bail application of the accused". 5.

In view of the aforesaid precedent and considering the gravity of the offence coupled with the fact that the trial is under progress as well as the consistent absence of the counsel for the applicant, I am not persuaded to entertain the application. 6.
