Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No.347 of 2024 registered with Chandwad Police Station, Dist. Nashik for the offences punishable under Sections 310(2), 126(2), 324(4), 352, 351(2), 111 of the Bhartiya Nyaya Sanhita, 2023. 2.
It is prosecution's case that on 15/09/2025 at around 11.00 p.m, the Applicant and co-accused robbed the first informant, who is truck driver, damaged his vehicle and robbed amount of Rs.4,500/- from his pocket by showing him threat of sharp weapons and assaulted him by sickle.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than 16 months. There is no progress in trial. Applicant has no antecedents. Applicant was not arrested from incident spot, he was arrested after some time of the incident and requested to allow the Application.

It is contention of learned APP that the Applicant and coaccused robbed the first informant while he was driving his truck, damaged his truck and taken away amount of Rs.4,500/- from his shirt's pocket. If Applicant released on bail, he may abscond or threaten First Informant and prosecution witnesses, charge is framed and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

Applicant is behind bars more than sixteen months and there is no progress in the trial. He has no antecedents. It may take time to conclude the trial.

Considering these facts, I pass following order.
ORDER
(i) The Applicant-Prakash @ Sunny Ramesh Aware be released on bail in Crime No.347 of 2024 registered with Chandwad Police Station, Dist. Nashik, on furnishing PR bond
of Rs.25,000/- with one or two solvent sureties in the like amont.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall attend the concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
