The Applicant seeks his release on bail in connection with C.R. No.16 of 2022 dated 16th February, 2022, registered with DCB - CID Unit 5, Kurla, Mumbai, for the offences punishable under Sections 302, 307, 120B, 201 and 34 of the Indian Penal Code, 1860 and under Sections 3, 4, 25 and 27 of the Arms Act, 1959.

Although, bail is sought on merits, at this stage Mr.Trivedi, learned counsel for the Applicant, prays for interim bail to the Applicant, for attending the last rites of his mother, who passed away on 13th October, 2025. 3.

Ms.Malhotra, learned APP, tendered a report of the Investigating Officer, pertaining to the request of the Applicant to be released on interim bail for the aforesaid purpose. She has verified the death certificate and submits, on instructions, that the Applicant's mother passed away and the Applicant is required to attend the last rites of his mother. 4.

In view of the aforesaid reason and purely on humanitarian ground, I am inclined to grant interim bail to the Applicant, only for the purpose of attending his mother's last rites. It is directed that Applicant be released on interim bail for a period of eight days from the date, on which he is released, for the purpose of attending his mother's last rites.

ORDER

i) The Applicant be enlarged on interim bail on cash bail of Rs.25,000/- for his release immediately; ii) The Applicant shall attend the office of DCB CID Unit - 5, everyday as per his convenience; iii) If the Applicant holds a passport, he shall deposit the same immediately on his release, with the the Police Station concerned;

iv) The Applicant shall not tamper or attempt to influence or contact the complainant, witnesses or any person concerned with the case;

v) The Applicant shall inform his latest place of residence and contact number immediately after being released and / or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the Police Station concerned;

(P.A.) 902-BA-3627-2025.doc vi) The Applicant to co-operate with the conduct of the trial;

vii) The Applicant shall surrender before the Jail authorities concerned, at 15:00 hours on the eighth day of his release without fail;

viii) Any infraction of the aforesaid conditions shall entail cancellation of bail and he is liable to be taken into custody immediately.

List this Bail Application on board on 21st November, 2025, for consideration on merits.
