By the present Application, the Applicant is seeking bail in Crime No.476 of 2021 registered with Wakad Police Station, Pune, under Section 302 and 181 of IPC and Section 75 of Juvenile Justice (Protection and Care of Children) Act, 2015. Mr. Mohammad S. Mulla states that the said Crime No.476 of 2021 is registered as Sessions Case No.925 of 2023 and is pending before the Court of the Additional Sessions Judge, Pune. 3.
After having heard the matter for substantial time and this Court having expressed its view of not being inclined to entertain the Application, Mr. Zahir Mulla, learned Advocate for the Applicant sought a pass-over to take
instructions from the Applicant.

At the request of Mr. Zahir Mulla, learned Advocate for the Applicant the matter was taken up after some time. Mr. Zahir Mulla, learned Advocate for the Applicant on instructions of the Applicant craves leave to withdraw the present Bail Application, he however, makes a prayer that the Prosecution be directed to examine the 3 minor witnesses (i.e. children of the Applicant) within a stipulated time.

Mr. Prasanna Malshe, learned APP for the State on instructions from the Investigating Officer, Wakad Police Station and on instructions from the learned APP appearing in Sessions Case No.925 of 2023 pending before the Court of the Additional Sessions Judge, Pune, states that the prosecution will examine the 3 minor witnesses before other prosecution witnesses and shall complete their oral testimony within a period of two (2) months from 1.12.2025. He submits that the Applicant should cooperate in the examination of the 3 minor witnesses and should not take any adjournments. 6.
Mr. Zahir Mulla, learned Advocate for the Applicant states that the Applicant shall not take adjournments.

Prosecution to abide by the statement made by Mr. Prasanna Malshe, learned APP for the State and to complete the examination/ oral testimony of the 3 minor witnesses, within two (2) months from 01.12.2025. The learned Additional Sessions Judge, Pune is requested to expedite the examination of the 3 minor witnesses and to make an endevour to complete their examination within two (2) months from 01.12.2025.

Upon completion of the examination of the said 3 minor children of the Applicant, the Applicant is at liberty to file a fresh Bail Application before the the Trial Court, which application shall be considered on its own merits and in accordance with law.
