By this Application, Applicant is seeking regular bail in Crime No.360 of 2024 registered with Wanawadi Police Station, Pune, for the offences punishable under Sections 302 read with section 34 of the Indian Penal Code, 1860 ('IPC' for short).

It is prosecution's case that on 27th May 2024, the Applicant and co-accused murdered the son of First Informant on account of old dispute. 3.
It is contention of learned counsel for the Applicant that no allegations are made in the FIR against the Applicant. The incident
occurred as a result of sudden quarrel. There was no intention to kill the deceased. The Applicant is behind bars for more than eight months. He has no antecedents and requested to allow the Application. 4.
It is contention of learned APP that, the deceased had gone to the house of the Applicant to attend the party hosted by the Applicant, where he was murdered. There is involvement of the Applicant in the present crime and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

In the FIR, there are no allegationa against the Applicant. It is mentioned that deceased had gone to the house of the Applicant for celebration of the party. It appears that the incident occurred out of sudden quarrel. The Applicant is behind bars for more than 8 months. He has no antecedents.

Considering these facts, I pass following order.
ORDER
(i) The Applicant-Shobhraj Dilip Vaidande be released on bail in Crime No.360 of 2024 registered with Wanawadi Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall attend the concerned Court as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
