By this application, the applicant seeks bail in C.R. No.419/2024, registered with Barshi Taluka Police Station, District Solapur, for offences punishable under Sections 103(1), 109, 118(1), 115(2), 352, 351(2), 126(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 135 of the Maharashtra Police Act 2.

Prosecution case is that, the land and house of accused No.1 Saudagar Patil is adjacent to the land and house of the informant. On 13/07/2024 accused No.1 abused and threatened Sindhu Patil on account of common boundary. On 23/12/2024, informant along with his mother Sindhu, father Kisan and younger brother Sagar had been to their agricultural land. Nirmala and the applicant were also present at their agricultural land. At about

2 9-BA-3685-25.odt 04:00 p.m. Sagar asked them not to create road from his land. Thereafter, at about 06:30 p.m. his mother, father and brother returned back to the house and informant stayed there for watering Jawar crop. Afterwards, he also proceeded to his house. At about 06:50 p.m. Sagar made phone call to informant and told that applicant along with other co-accused restrained their bullock cart on the count of previous quarrel, therefore, informant reached on spot. At that time, all the accused persons were assaulting his father, mother and brother with kick and fist blows and abusing them. It is further alleged that accused No.1 assaulted Sagar with knife on his stomach and applicant and Nirmala were holding Sindhu. At that time accused No.1 assaulted Sindhu with knife on her stomach. Accused No.

1 also assaulted Kisan with same knife on his left chest and back. In the said incident informant also got injured. Thereafter, some villagers intervened the said quarrel and shifted the injured to Suvidha Hospital, Barshi. In that incident, Sagar, brother of informant and mother Sindhu were declared dead and father Kisan was shifted to Jagdale Mama Hospital for further treatment.

Heard learned advocate for applicant, learned APP for respondent / State and learned advocate for intervenor. Perused the record.

Applicant is seeking bail on the ground of parity as the similarly situated co-accused Nirmala Dadasaheb alias Dadarao Patil is granted bail by the Apex Court vide order dated 20/11/2025 passed in Criminial Appeal No(s).4955/2025. In the said order it is observed that, "5. The learned counsel for the respondent has opposed the prayer for bail, however, could not dispute that no role of causing injury by any dangerous weapon is ascribed to the appellant.

Having regard to the nature of allegations qua the appellant, as also her age, including the fact that she is a lady, we deem it appropriate to accept the bail prayer of the appellant."

Indeed, similar role is attributed to the applicant herein and therefore, applicant is entitled for bail on the ground of parity. 6.

In the result, application is allowed. Applicant Sonali Saudagar Patil be released in connection with C.R. No.419/2024, registered with Barshi Taluka Police Station, District Solapur, on executing personal bond of Rs.15,000/- with one surety in the like amount.

The applicant shall not tamper with the prosecution evidence. Applicant shall regularly attend the trial. (NITIN B. SURYAWANSHI, J.)
