After hearing the Application at length, when this Court was not inclined to interfere with the Application, at that time, the learned Advocate for the Applicant submitted that the Applicant is suffering from a mental disorder and tried to point out the Disability Certificate (Page No.301, Exh.C). 2.
Learned Advocate for the Applicant on instruction further submits that the Applicant does not want to proceed with the Application, as such, he seeks leave to withdraw the Application with liberty to file an Application before the learned Trial Court for referring the Applicant to medical examination at Sir J. J. Hospital, Mumbai, to ascertain his mental condition. After examination of the Applicant and obtaining the medical report, he will file a Bail Application afresh before the Trial Court.
