The applicant is arrested in Crime No.74 of 2025 for the offence punishable under Sections 318(4), 336(3), 338, 3(5) of Bhartiya Nyaya Sanhita (for short 'BNS'), under Sections 3(a), 6(a) of Passport (Entry into India) Rule, 1950, under Section 3(1) of Foreigners Order, 1948, under Section 14 of Foreigner Citizens Act, 1946.

On receipt of the secret information that some Bangladeshi residents are residing in above mentioned area. They found the present applicant and other co-accused named Najma Yashin Shaikh @ Bithi Begum Yasin Shaikh along with this applicant. They entered

India illegally without any valid travel documents and without written permission of the Indian Border Officer. The applicant and coaccused were found in two storey houses in Solapur. Police recovered Rs.1,41,600/- cash and mobile phones.

The applicant has filed this application for release on bail as she is staying in India unauthorisedly.

When the raid was conducted, the applicant was found along with the one voter identity card and one Aadhar card. As per the statement made by the learned counsel for the applicant that the voter identity card is of Rehana Begum and the Aadhaar card is of Sathi Rubel Khan. Those two persons are different. The Aadhaar card of Sathi Rubel Khan is found, which is coloured xerox and not the original Aadhaar card. It is sent to Central Government to verify. The Central Government is verifying the documents including Aadhaar card, Therefore, no case is made out as the applicant herself signed the document as the Rehana Begum. Though it is argued that the Rehana Begum and Sathi Rubel Khan are different persons, she herself has given the statement and signed as Rehana Sathi. Therefore, no case is made out to release the applicant on bail.

If there is any procedure to disclose the identity, then the authority to take steps.
