Applicant seeks bail in Crime No. 391 of 2025, registered with Vishram Bag Police Station, Sangli for the offences punishable under Sections 179 of the Bharatiya Nyaya Sanhita, 2023. 2.

The prosecution case in short is that applicant Smt. Rashad Mulla has an account in Sangli urban Co-operativve Bank Ltd., Timber area, Sangli. On 19th November, 2025, at about 11.30 a.m. the applicant gave 172 currency notes of Rs. 500/-, total of Rs. 86,000/- to be deposited in her account. The counting machine does not count 19 currency notes. On inquiry, the applicant told that she received those notes by selling her plot. The cashier i.e. informant-Vishvas Patil

stated these facts to the Manager and he informed the same fact to Head Office. Thereafter, as per Rules of Reserve Bank of India, those 19 currency notes were impounded being fake currency notes and necessary form was filled by the applicant and the notes were sent to S. P. Office, Sangli for further investigation. Thereafter, the informant was called in Vishram Bag Police Station and he gave FIR on 03rd December, 2025.

Heard learned advocate for the applicant, learned APP for the State and learned advocate for the informant. Perused the investigation papers.

Learned APP has strenuously opposed the application by stating that the applicant was found in possession of counterfeit currency notes which she has deposited in bank.

The applicant is lady, who is arrested on 3rd December, 2025. The co-accused, who were arrested on 4th December, 2025 have been granted bail by the trial Court.

Taking into consideration the gender of the applicant and the fact that the co-accused have been granted bail by the trial Court, the applicant is entitled for bail on the ground of parity 7.

In the result, application is allowed.

The applicant- Rashad Javid Mulla be released on bail in Crime No. 391 of 2025, registered with Vishram Bag Police Station, Sangli

for the offences punishable under Sections 179 of the Bharatiya Nyaya Sanhita, 2023, on executing Personal Bond of Rs. 15,000/- with one surety in the like amount.

Applicant shall attend the concerned police station as and when called by the investigating officer, till filing of the charge-sheet. Applicant shall not tamper the prosecution evidence. (NITIN B. SURYAWANSHI, J.)
