The Applicant has filed this application on the ground of delay in trial. The report was called for and as per the report as the accused No.2 is absconding the charge was not framed. Earlier the Court has granted liberty to this Applicant to apply after six months if the trial is not concluded. The Applicant is coming before this Court as in the stipulated period the trial is not concluded, even the charge is not framed. As per the report because of co-accused the trial was not concluded.

The counsel for Applicant informed this Court that the coaccused is in custody of crime in Karnataka police station in some other matter since August 2025 and therefore, the accused No.2 was not absconding.

As it is informed by the counsel for the Applicant that accused No.2 is in custody in other matter, the trial Court is directed to call for the production of said accused in this crime and initiate the trial and expedite the trial.
