By order dated 8th October 2025, the Registrar (Judicial-I) was requested to call report from the Trial Court concerned as to why despite orders of this Court, there was no progress in the trial.

Report sent by the District Judge-5 and Additional Sessions Judge, Kalyan, dated 31st October 2025, is placed on record.

I have gone through the said Report. It transpires from the Report that delay in trial is caused by the Defence themselves.

In this view of the matter, when this Court indicated its disinclination to grant bail to the Applicant, Mr. Umar Farooque Nizami, learned counsel appearing for the Applicant, sought permission to withdraw the present Bail Application.

In view of the previous orders passed by this Court as well as Report dated 31st October 2025 submitted by the District Judge-5 and Additional Sessions Judge, Kalyan, the said Trial Court is directed to expedite the trial and to conclude the same preferably within one year from the date, on which this order is placed before it.

Permission to withdraw is granted.

Disposed as withdrawn.
