Heard learned counsel for the Applicant, learned APP for State and learned counsel for Respondent No.2.

By this Application, the Applicant is seeking regular bail in Crime No.479/2022 registered with Talegaon Dabhade Police Station, Dist. Pune for the offences punishable under Sections 302, 143, 147, 148, 149, 506, 120(B) of the Indian Penal Code, 1860 and under Sections 4(24) of the Arms Act, Sections 37(3) (1) r/w. Section 135 of the Maharashtra Police Act a/w. Section 7 of the Criminal Law Amendment Act and Section 3 (1)(i) (ii), 3(4) of the MCOCA Act. 3.
It is prosecution's case that on 06/11/2022 Applicant and coaccused murdered the deceased by assaulting him with sickle and sharp
weapons.

It is contention of learned counsel for the Applicant that the coaccused Anshul Sharma who assaulted the deceased with fist and kick blows, has been released on bail by the Hon'ble Apex Cout. The allegations against Anshul Sharma and Applicant are same. Hence Applicant is entitled for bail on principle of parity and requested to allow the Application.

It is contention of learned APP that Applicant assaulted the deceased with fist and kick blows. He was part of group, who murdered the deceased. Parity will not be applicable to the Applicant and requested to reject the Application.

I have heard all learned counsel. Perused charge-sheet and documents produced on record.

The allegations against Anshul Sharma and Applicant are similar. Hence Applicant is entitled for bail on principle of parity. 8.
Considering this fact, I pass following order.
ORDER
(i) The Applicant- Amit Shrikrushna Takle be released on bail in Crime No.479/2022 registered with Talegaon Dabhade Police Station, Dist. Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
