By this Application, Applicant is seeking regular bail in Crime No.128 of 2025 registered with Lasalgaon Police Station, Nashik Rural, for the offences punishable under Sections 109(1), 115(2), 352, 351(2)(3) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 ('BNS' for short) and Sections 37(1)(3) read with Section 135 of the Maharashtra Police Act. 2.

It is prosecution's case that, on 18th May 2025 in between 5.00 to 5.30 p.m., the Applicant and co-accused assaulted First Informant with a sickle, with an intention to kill him, on account of an old dispute.

It is contention of learned counsel for the Applicant that, First Informant has suffered simple injuries. The co-accused has been released on bail. The Applicant is behind bar more than 7 months. The investigation is completed and charge-sheet has been filed. There is no progress in the trial. Hence, requested to allow the Application.

It is contention of learned APP that, the injuries are simple but those were on vital part of the body. If Applicant is released on bail, he may abscond or threaten First Informant and prosecution witnesses. Hence, requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Applicant is behind bar for more than seven months. Investigation is completed and charge-sheet has been filed. The co-accused having similar allegations is released on bail. It may take time to conclude the trial.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Ketan @ Kedu Ramesh Pathare be released on bail in Crime No.128 of 2025 registered with Lasalgaon Police Station, Nashik Rural, on furnishing PR bond

of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
