The matter was kept for production at the request of learned counsel for the Applicant on the ground that the Applicant is unwell and needs urgent medical attention. Ms.Malhotra, learned APP, representing the State, tendered report dated 2nd November, 2025, issued by the Superintendent, Mumbai Central Prison, Mumbai -11. The said report is taken on record and marked as Exhibit 'A' for identification purpose. I have perused the said report. It appears that the applicant is healthy and for certain injuries 7th November 2025

Prasad Rajput (P.A.) 501-BA-3930-2025.doc that he complained of, he was advised paracetamol tablets and multivitamins. The report of the Superintendent of the prison details medical checkup of the Applicant and its outcome.

I see no reason to grant bail to the Applicant on the medical ground.

At this stage, Mr. Mulani, learned counsel for the Applicant, states that the present Bail Application was filed before this Court as charge-sheet was not filed in the Trial Court. Now, the charge-sheet has been filed before the Trial Court and in such circumstances, he seeks permission to withdraw the present Bail Application with liberty to file a fresh bail application before the Trial Court. Permission is accordingly granted with the aforesaid liberty. 5.

Bail Application stands disposed of as withdrawn. (DR. NEELA GOKHALE, J) 7th November 2025
