Learned counsel for the Applicant submits that this is a case of circumstantial evidence and except of the alleged statement of the Applicant recorded before the Police, there is no evidence to connect him with the crime. He seeks bail also on the ground that the Co-accused are enlarged on bail by this Court by an order dated 4th July 2025 passed in Criminal Bail Application No. 1961 of 2025 with Criminal Bail Application No.1943 of 2025. 2.

The learned APP opposes the Application by pointing out statements of two witnesses, who state about the presence of the Applicant-Accused at the spot. Apart from this recovery of bloodstained clothes of the Accused is also referred to. She however, makes a statement that C.A. Report is yet to be received. 26th March, 2026.

In absence of C.A. Report, it cannot be ascertained as to whether recovery of clothes of the Applicant is an incriminating circumstance or not.
