Heard learned counsel for the Applicant and Learned APP for State.

By this Application, the Applicant is seeking regular bail in Crime No. I-0498 of 2024 registered with Panvel City Police Station for the offences punishable under Section 103(1) of The Bhartiya Nyaya Sanhita, 2023.

It is prosecution's case that Applicant murdered the deceased by stabbing him with knife on the ground of financial dispute. 4.

It is contention of learned counsel for the Applicant that prosecution case is based on circumstantial evidence There is no recovery

at the instance of the Applicant. Applicant is behind bars more than one year and six months. He has no antecedents and requested to allow the Application.

It is contention of learned APP that there is a cctv footage which shows after committing murder of the deceased, Applicant was seen going on the road. The knief which was used in crime, recovered at the instance of the Applicant. He submits that if Applicant released on bail, he may abscond and requested to reject the Application. 6.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

Prosecution case is based on circumstantial evidence. The knief is recovered from the incident spot. To prove the allegations against the Applicant, trial is required. Applicant is behind bars more than one year and six months . He has no antecedents. It may take time to conclude the trial.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Amitkumar Ramashway Ray be released on bail in Crime No. I-0498 of 2024 registered with Panvel City Police Station, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.
