By this application, the applicants are seeking regular bail in C.R. No.232 of 2025 registered with Khadak Police Station, Pune, for the offences punishable under Sections 303(2), 112(2) r/w 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short "BNS Act").

It is the prosecution's case that, the co-accused has stolen the gold biscuits of the first informant while shifting coffer of the first informant. It is alleged that the said gold biscuits were given to the Applicants for melting. It is the contention of the learned counsel for the Applicants that the Applicants are behind the bars for more than nine months. The co-accused has been released on bail against whom, the allegations of theft are made. The Applicants have no antecedent and
requested to allow the application.

It is the contention of the learned APP that the Applicants have melted gold biscuits given by the co-accused, which shows their involvement in the crime. If the Applicants are released on bail, they may abscond and requested to reject the application. 4.
I have heard both the learned counsels, perused the chargesheet and the documents produced on record. The co-accused having allegations on higher footing, has been released on bail. The applicants are behind the bars for more than nine months. The Applicants are entitled for bail on principal of parity and I pass the following order :-
ORDER
(i) The applicants be enlarged on bail in Crime No.232 of 2025 registered with Khadak Police Station, Pune on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.
(ii) The applicants shall attend the concerned police station as and when required.
(iii) The applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is
accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
