After hearing counsel for both sides and when this Court has shown dis-inclination to grant any relief to the Applicant at this stage, learned counsel for the Applicant seeks withdrawal of the Application with direction to the Trial Court to expedite the trial.

Learned APP and learned counsel for Respondent No.2 drew attention of the Court relying upon Roznama of the Trial Court proceedings indicating that the counsel for the Applicant / Accused is not appearing before the Trial Court since June, 2025. If it is so, the prosecution is not responsible for the delay in the trial, if any.

In any case, since the evidence of the prosecution has already commenced, the Trial Court to complete the trial within a period of six months from today. In case none appears on behalf of the accused before the Trial Court, it is open for the Trial Court to appoint legal aid counsel.
