By this Application, the Applicant is seeking regular bail in Crime No.178 of 2025 registered with Hinjewadi Police Station, Pune, for the offences punishable under Sections 143(3), 143(4), 3(5) of the Bharatiya Nyaya Sanhita, 2023 ('BNS' for short), Sections 3,4,5 and 7 of the Immoral Trafficking (Prevention) Act, 1956 and Section 14 of the Protection of Children from Sexual Offences Act, ('POCSO' for short)

It is prosecution's case that, on secret information Police conducted raid at Aatithi Lodging and Boarding, Wakhad and found that prostitution was being carried on there. It is alleged that the Applicant is owner of the said lodge and he was providing rooms for prostitution by taking amount.

It is contention of learned counsel for the Applicant that, the Applicant is behind bar for more than 10 months. Investigation is completed and charge-sheet has been filed. There is no progress in the trial. Hence, requested to allow the Application. 4.

It is contention of learned APP that, the Applicant has one antecedent. He was providing room for prostitution in lieu of amount. It shows his involvement in crime. If Applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The Investigation is completed and charge-sheet has been Filed. The Applicant is behind bar for more than 10 months. There is no progress in trial. It may take time to conclude the trial.

Considering these facts, I pass following order.

ORDER

(i) The Applicant-Pravin Baliram Asatkr be released on bail in Crime No.178 of 2025 Hinjewadi Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
