Heard learned counsel for the Applicant and Learned APP for State.

By this Application, the Applicant is seeking regular bail in Crime No.08 of 2025 dated 26/02/2025 registered with Cyber Police Station, Pimpri-Chinchwad, Pune for the offences punishable under Sections 316(2), 318(4), 3(5) of Bhartiya Nyaay Sanhita, 2025 and Section 66(C) Section 66(D) of the IT Act.

It is prosecution's case that unknown persons cheated the first informant to invest the amount with the assurance of handsome returns, but they did not return the amounts nor investment on it. It is alleged that out of the cheated amount, Rs.7,00,000/- was transferred in the bank account of the Applicant.

It is contention of learned counsel for the Applicant that the Applicant is behind bars around eight months. He has no antecedents. To show bonafides, Applicant has deposited Rs.7,00,000/- before the trial Court and requested to allow the Application. 4.
It is contention of learned APP that the Applicant was part of group, who cheated the first informant. The total fraud is Rs. 1,09,00,000/-. He submits that if Applicant released on bail, he may abscond and requested to reject the Application. 5.
I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant are that amount of Rs.7,00,000/- was transferred in his bank account. The Applicant has deposited the said amount. Applicant has no antecedents. He is behind bars around eight months.

Considering these facts, I pass following order.
ORDER
(i) The Applicant-Bhoumik Bharatbhai Patel be released on bail in in Crime No.08 of 2025 dated 26/02/2025 registered with Cyber Police Station, Pimpri-Chinchwad, Pune on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or
influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.
