By this application, the applicant is seeking regular bail in Crime No. 101 of 2025 registered with Bhadrakali Police Station, District Nashik, for the offences punishable under Sections 108, 115(2) and 352 of the Bharatiya Nyaya Sanhita, 2023.

It is prosecution's case that between January 2024 and 15th March 2025, the applicant, who was a tenant of the mother of the first informant, abused and physically and mentally harassed her. It is contention of learned counsel for the applicant that the SHUBHADA SHANKAR KADAM applicant is behind bars for around 11 months. At the time of the incident,
he was not a tenant of the mother of the first informant. The applicant has no antecedents and requested to allow the application. 4.
It is contention of learned APP along with learned counsel for respondent No. 2 that the applicant was the erstwhile tenant of the mother of the first informant. He was harassing her by drinking liquor. There are eyewitnesses who have seen the applicant harassing the mother of the first informant. The mother of the first informant had filed two NC complaints against the applicant. The applicant has two antecedents. If he is released on bail, he may abscond or threaten the prosecution witnesses. Hence, requested to reject the application.

I have heard all learned counsel, perused the charge-sheet and documents produced on record. The allegation against the applicant is of abetment of suicide. The applicant is behind bars for around 11 months. Considering these facts, I pass following order:
ORDER
(i) The applicant be enlarged on bail in Crime No. 101 of 2025 registered with Bhadrakali Police Station, District Nashik, on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.
(ii) The applicant shall attend the concerned police station as and when required.
(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.
The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
