On 27th February 2026, the following order was passed. "1. None appears for the Applicant either in the Court Hall or through V. C. when the matter is called out. It appears that on 4th November 2025, the Applicant filed this Application, and it has been pending since then.

2. The learned A.P.P. submitted that, on 2nd December, 2025, the chargesheet was filed in the matter. Therefore, she contended that the Applicant can move the application before the Trial Court afresh.

3. Having considered the above facts, list the matter on 13th March, 2026, for passing necessary orders as a last chance." 2.

Today, the learned Advocate for the Applicant, Mr. Patel, appeared through video conferencing and submitted that the prosecution has filed a charge sheet in the Court, and therefore, the Applicant does not want to proceed with this application. Hence, he seeks leave to withdraw the application for which the learned APP does not object.
