The Applicant seeks his enlargement on bail in connection with CR No.25 of 2022 registered with the Anti Narcotic Cell (ANC), Worli Unit, Mumbai for the offence punishable under Sections 8(c), 22(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the Applicant, submits that the coaccused, against whom greater role has been attributed in this crime are enlarged on bail. To support this submission he places reliance on order dated 16th February, 2026 passed in Bail Application No.1195 of 2025, order dated 17th May, 2024 passed in Bail Application No.806 of 2024, order dated 15th October, 2024 passed in Spl. Leave to Appeal (Crl) No.11119 of 2024, order dated 16th February, 2026 passed in Bail Application No.1836 of
2025 and order dated 12th February, 2026 passed in Bail Application No.2258 of 2025 .

Learned APP though opposes the bail application, but she was unable to point out that this is not a case for parity. 4.
Having regard to the orders passed in applications for bail filed by the co-accused and considering the role alleged against them, coupled with the fact that the Applicant has no criminal history against him, this is a fit case for allowing the application on same conditions. Hence, the following order.
ORDER
i) The Applicant be enlarged on bail, on executing PR Bond in the sum of Rs.1,00,000/- with one or two local sureties in the like amount;
ii) The Applicant shall attend the Police Station concerned, on first Monday of every month between 10:00 a.m. and 12:00 p.m. He shall also attend the Trial Court concerned on each and every date as directed, till the conclusion of the trial, save and except if the Applicant is exempted from appearance by orders of the Trial Court. iii) The Applicant shall not leave the State of Maharashtra till the conclusion of the trial;
iv) If the Applicant has not deposited his passport, the Applicant shall deposit the same with the concerned Police Station, if any;
v) The Applicant shall not leave India, without permission of the trial Court;
vi) The Applicant shall not tamper or attempt to influence or contact the complainant, witnesses or any person concerned with the case;
vii) The Applicant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the concerned Police Station; viii) The Applicant to co-operate with the conduct of the trial;
ix) Any infraction of the aforesaid conditions shall entail cancellation of bail.

Bail Application is allowed in the above terms and is accordingly disposed of.

It is made clear that the observations made herein are prima facie and are confined to this Application and the learned Trial Judge to decide the case on its own merits, uninfluenced by the observations made herein.
