Learned counsel for the Applicant submits that there are material discrepancies in the complaint as well as the panchanama of seizure of the contraband from the present Applicant. In this regard, he referred to the said documents indicating the discrepancy in recording exhibit number. It is his further submission that as per the case of the prosecution, independent witnesses were present at the spot, however, not single a statement of any independent witness has been recorded.

The learned APP opposes the Application by contending that independent witnesses though were available, they refused to record any statement. Hence, the statement is not there on record. She seeks time to make further submissions. 13th March, 2026.
