By this application, the applicant is seeking regular bail in Crime No. 435 of 2024 registered with Vadgaon Nimbalkar Police Station, District Pune, for the offences punishable under Sections 137(2) and 64(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 4, 6, 8, 10 and 12 of the Protection of Children from Sexual Offences Act, 2012. 2.
It is prosecution's case that on 4th December 2024, the applicant kidnapped the minor daughter of the first informant and sexually assaulted her on the promise of marriage.

It is contention of learned counsel for the applicant that the SHUBHADA SHANKAR KADAM applicant is behind bars for more than one year. There was love affair
between the applicant and the victim and the victim had voluntarily gone with the applicant. There is delay in lodging the complaint. Hence, requested to allow the application.

It is contention of learned APP that the victim was around 14 years old and the applicant was aware of her age. The medical report supports the prosecution's case. Hence, requested to reject the application. 5.
I have heard all learned counsel and perused the documents. There is delay in lodging the complaint. The applicant was 23 years old at the time of the incident. The applicant has no antecedents. He is behind bars for more than one year. It may take time to conclude the trial. Considering these facts, I pass following order L
ORDER
(i) The applicant be enlarged on bail in Crime No. 435 of 2024 registered with Vadgaon Nimbalkar Police Station, District Pune, on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.
(ii) The applicant shall attend the concerned police station as and when required.
(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.
The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
