This is an application for regular bail.

The applicant came to be arrested in Crime No.695 of 2022 registered at Chikhali Police Station for the offences punishable under Section 302 read with 34 of the Indian Penal Code, Section 4(25) of the Arms Act and Section 37(1) (3) read with 135 of the Maharashtra Police Act.

It is the case of the prosecution that on the date of incident, which took place on 23rd December 2022, on account of previous dispute the present applicant and other co-accused assaulted the deceased by sharp weapon (Palghan) and sword and committed his murder.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

Learned counsel for the applicant submits that the motive for the alleged crime is not attributed to the present applicant. It is submitted that the applicant is in jail for three years and except framing of charge, there is no progress in the trial. 6.

On the other hand, learned APP for the respondent/State submits that there are eye-witnesses to the incident. It is submitted that the present applicant had called the deceased at the place of incident. It is submitted that considering the nature of crime, the applicant may not be released on bail. 7.

I have perused the charge-sheet. It appears that the motive for alleged crime is not attributed to the present applicant. The applicant is in jail for more than three years. There are no other criminal antecedents against the applicant. Considering the said facts, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 695 of 2022 registered at Chikhali Police Station for the offences punishable under Section 302 read with 34 of the Indian Penal Code, Section 4(25) of the Arms Act and Section 2/3

37(1) (3) read with 135 of the Maharashtra Police Act on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C] The applicant shall attend the concerned police station once in a month ,i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial.

D] The applicant shall not tamper with the prosecution evidence.
