By this Application, Applicant is seeking regular bail in Crime No.104 of 2024 registered with Sangavi Police Station, Pune, for the offences punishable under Sections 8(c), 20(B)(ii)(b), 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 ('NDPS Act' for short) and Sections 3(1)(ii), 3(2) and 3(4) of the The Maharashtra Control of Organised Crime Act, 1999 ('MCOC' Act). 2.

It is prosecution's case that on 17th March 2024, while patrolling on secret information, police found the Applicant and co-

accused standing in the corner of the road in suspicious manner. The Applicant was on a motorcycle. It is alleged that in personal search of the Applicant, police found 1 kg ganja in the dickey of the Applicant motorcycle.

It is contention of learned counsel for the Applicant that the Applicant is behind bars for more than one year and ten months. There is no progress in the trial. The applicable has no antecedents and requested to allow the Application.

It is contention of learned APP that the Applicant is member of crime syndicate. The provisions of the MCOC are applied against him. The Applicant has been arrested on the spot with ganja. If Applicant released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the Application. 5.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The quantity of ganja found in possession of the Applicant is non-commercial quantity. The Applicant is behind bars for more than one year and ten months. He has no antecedents. There is no progress in the trial.

Considering these facts, I pass following order.

ORDER

(i) The Applicant be released on bail in Crime No.104 of 2024 registered with Sangavi Police Station, Pune,, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.

(iv) The Applicant shall attend the concerned Police Station as and when required.

(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
