By this Application, the Applicant is seeking bail in Crime No.29 of 2025, registered with Dehu Road Police Station, for the offences punishable under Sections 109(1), 118(1), 115, 351(2), (3), 352, 3(5) of Bhartiya Nyaya Sanhita, 2023 r/w. Sections 37(1), (3), 135 of Maharashtra Police Act.

It is prosecution's case that on 19th February 2022 at around 3.30 p.m., the Applicant and co-accused assaulted the First Informant due to official dispute with intention to kill him.

It is contention of the learned counsel for the Applicant that

Applicant is behind bars more than nine months. The co-accused, having similar allegations, has been released on bail. Applicant has two antecedents. Hence, requested to allow the Application on the principle of parity. 4.

It is contention of the learned APP that, the Applicant and coaccused assaulted the informant with sickle and stones with an intention to kill him on the ground of official dispute. If the Applicant is released on bail he may abscond and threaten the prosecution witnesses and, requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet. 6.

The Applicant is behind bars for more than nine months. The co-accused, having similar allegations, has been released on bail. The Applicant is entitled for bail on principle of parity and I pass following order.

ORDER

(i) The Application is allowed.

(ii) The Applicant be enlarged on bail Crime No.29 of 2025, registered with Dehu Road Police Station on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.

(iii) The applicant shall inform his latest place of residence and mobile number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Investigating Officer.

(iv) The Applicant shall attend Court dates regularly. (v) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of.
