By this Application, Applicant is seeking regular bail in Crime No.10 of 2025 registered with Samarth Police Station, Pune for the offences punishable under Sections 352, 351(2), 3(5), 118(2), 117(2), 115(2), 109 Bharatiya Nyaya Sanhita, 2023 ('BNS' for short), Sections 37(3) and 37(1) read with Section 135 of the Arms Act and Section 4(25) read with Section 135 of the Maharashtra Police Act.

It is prosecution's case that on 18th January 2025, around 9.15 p.m., the Applicant and co-accused assaulted First Informant and his son with sharp weapon with an intention to kill them. It is contention of learned counsel for the Applicant that, the allegations against the Applicant are that he assaulted the son of the First Informant with fist and kick blows. The Applicant is behind bars for more than one year. There is no progress in trial. The Applicant has no antecedents and requested to allow the Application.

It is contention of learned APP that the Applicant was part of group, who assaulted son of the First Informant with an intention to kill him. The First Informant also got injured in said assault. If Applicant released on bail, he may abscond or threaten First Informant and prosecution witnesses, and requested to reject the Application. 5.
I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant are that he assaulted the son of the First Informant with fist and kick blows. The main allegations are against the co-accused. There is no progress in trial. The Applicant has no antecedents. It may take time to conclude the trial.

Considering these facts, I pass following order.
ORDER
(i) The Applicant-Wilson Rajesh Thakur be released on bail in Crime No.10 of 2025 registered with Samarth Police Station, Pune, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order.
(iv) The Applicant shall attend the concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
