Heard learned counsel for the Applicant and Learned APP for State.

By this Application, the Applicant is seeking regular bail in Crime No. 38 OF 2021 registered with Chinchwad Police Station for the offences punishable under Sections 302, 201 read with 34 of the Indian Penal Code, 1860.

It is prosecution's case that Applicant and co-accused murdered the deceased by assaulting him with sharp weapons. Initially offence was registered against the unknown persons.

It is contention of learned counsel for the Applicant that dead body of unknown person was found on 12/02/2021 and supplementary
statement of the first informant was recorded on 17/06/2022. In the said supplementary statement, name of Applicant is mentioned as murderer of the deceased. Applicant is behind bars more than three years and eight months. There is no progress in the trial. Applicant has no antecedents and requested to allow the Application.

It is contention of learned APP that Applicant has been arrested from crime area. He submits that if Applicant released on bail, he may abscond. Applicant murdered the deceased. The co-accused is absconding. There is progress in the trial and requested to reject the Application. 6.
I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The dead body of unknown person was found on 12/02/2021. In supplementary statement of first informant recorded on 17/06/2022, Applicant's name is mentioned as murderer of the deceased. There is delay of more than one year and four months of recording supplementary statement. Applicant is behind bars more than three years. There is no progress in the trial. It may take time to conclude the trial. 8.
Considering these facts, I pass following order.
ORDER
(i) The Applicant- Subodhkumar Akindarprasad Kushvah be released on bail in Crime No. 38 OF 2021 registered with Chinchwad
Police Station, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the Chichwad Police Station once in a month on every first Monday of the month between 11.00 a.m. to 1.00 p.m. till recording statement of the first informant. (v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
