By this application, the Applicant is seeking regular bail in C.R.No. 1745 of 2020 registered with Kothrud Police Station, DistrictPune, for the offence punishable under Sections 302, 143, 144, 147, 149, 404, 449, 201 and 34 of Indian Penal Code, 1860 (for short "IPC") and Sections 37(1) r/w 135 of Bombay Police Act and Sections 4 and 25 of Arms Act.

It is prosecution's case that applicant and co-accused assaulted and murdered the deceased by assaulting him with sharp weapon on the ground of old enmity.

It is contention of learned counsel for the applicant that co-

accused having similar allegations has been released on bail on the ground of long incarceration. Hence, applicant is entitled for bail on principle of parity.

It is contention of learned APP that the applicant has been identified in Test Identification Parade. Hence, parity would not be applicable and requested to reject the application. 5.

I have heard both the learned counsel. Perused chargesheet and documents produced on record. The co-accused - Ajay Dinkar Suryawanshi having similar allegations has been released on bail by this Court (Coram : Ashwin D. Bhobe, J.) by order dated 18.07.2025. Considering this fact, the applicant is entitled for bail on principle of parity and I pass following order.

ORDER

i.

The applicant be enlarged on bail in C.R.No. 1745 of 2020 registered with Kothrud Police Station, DistrictPune, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount. ii.

The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not

tamper with the evidence.

The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
