Learned counsel for the Applicant submits that herein in this case, there are inconsistencies in the statement of the Informant with regard to the Assailant. Similarly, according to him, the deceased (then Injured) had informed to the Doctor about the assault being caused on him by an unknown person. In these circumstances, a doubt is created with regard to the allegations made in the First Information Report against the present Applicant by naming him as the Assailant. It is his further submission that for want of any previous enmity, there was no motive for the Applicant to kill the deceased. He further argues that alleged injuries caused to the deceased are not on the vital parts of his body in order to attribute intention of the Applicant to kill him. Finally, it is argued 1st April, 2026.

27-BA-4410-2025.DOC that though CCTV footage was handed over to the Police, no transcript has been prepared thereof.

Learned APP drew attention of the Court to the statements of eye witnesses, which according to her, indicate that the Applicant caused assault on the deceased and as many as 18 injuries are caused to him. She also drew attention of the Court to the cause of death recorded by the Medical Officer. She seeks time to make submissions with regard to the transcript of the CCTV footage, if any, in the charge-sheet.
