This is an application for regular bail.

The applicant came to be arrested in Crime No. 131 of 2022 registered at Samarth Police Station, for the offences punishable under Sections 302 & 307 read with 34 of the Indian Penal Code and Section 37 read with 135 of the Maharashtra Police Act.

It is the case of the prosecution that on the date of the incident which took place on 26.07.2022, on account of previous enmity, the present applicant and other co-accused assaulted the first informant and the deceased by sharp weapons and stones. It is alleged that the deceased died due to the injuries sustained in the

incident.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State. 5.

Considering the fact that the applicant is in jail for three years and eight months this Court on 18.02.2026 passed the following order :

Mentioned out of turn.

Considering the facts and circumstances of the case, the trial Court shall make an endeavour to examine the injured eyewitness, viz., Atul Gangadhar Gaikwad on the next date, which I am told is 27th February 2026. If for some reasons, the trial court is required to adjourn the matter on the next date, then the trial court shall make an endeavour to examine the said witness within a period of three weeks.

List the Application on 12th March 2026.

The learned APP submits that the said injured witness could not be examined. In that view of the matter, I am inclined to release the applicant on bail. In the result, the following order is passed:

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in Crime No. 131 of 2022 registered at Samarth Police Station, for the offences

punishable under Sections 302 & 307 read with 34 of the Indian Penal Code and Section 37 read with 135 of the Maharashtra Police Act, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C] The applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11:00 am to 2:00 pm, till conclusion of the trial.
