Heard learned counsel for the Applicant and learned APP for the Respondent-State.

The learned counsel for the Applicant seeks bail on the
54-BA-4487-2025 WITH 4563-25.doc N.S.Kamble ground that, the Applicant is behind bar more than 4 years. The maximum punishment for the offence registered against the Applicant is 7 years.

The learned APP submitted that this issue was not raised before the Trial Court, hence, direction be given to the Applicant to file fresh Application before the Trial Court.

The learned counsel for the Applicants, on instructions, seeks leave to withdraw Applications with liberty to file fresh Application before the Trial Court on the issue raised before this Court. 5.
Considering the submission of the learned counsel for the Applicants, the Applications are allowed to be withdrawn with the aforesaid liberty.

If the Application for bail is filed the Trial Court shall decide the said Application on its own merit and shall decide it as early as possible.

Both Applications are disposed of.
