At the very outset, Ms. Anuja Gotad, learned APP representing the State in the matter, on instructions, states that the trial has commenced; five witnesses are already examined and the prosecution intends to examine only six witnesses in all.

On the basis of above statement, Mr. Mohammed Umar Kazi, learned counsel appearing for the Applicant, on 4th December 2025

Shivgan 6_BA_4505_2025.doc instructions, seeks permission to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court concerned after one year from the date on which this order is communicated to the Trial Court concerned, if the trial does not progress substantially within the said period.

Permission to withdraw with the aforesaid liberty is granted.

Disposed as withdrawn.
