By this Application, the Applicant is seeking regular bail in Crime No. 817 of 2019 registered with Pimpri Police Station for the offences punishable under Sections 302, 364, 326, 504, 201, 34 of the Indian Penal Code (for short 'IPC') and under Sections 3(1)(i) (ii), 3(4) of the The Maharashtra Control of Organised Crime Act, 1999 ('MCOC' Act). 2.
It is prosecution's case that the Applicant and co-accused kidnapped the deceased in car and murdered him on the ground of quarrel.

It is contention of learned counsel for the Applicant that coaccused - Sanjay Bhosale, having similar allegations, has been released on
bail by this Court [N.R. Borkar, J.] and submits that applicant is entitled for bail on principle of parity and requested to allow the application. 4.
It is contention of learned APP for the State that Applicant and co-accused kidnapped the deceased in car and assaulted him with sharp weapon. If Applicant is released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the application. 5.
I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The co-accused, having similar allegations, has been released on bail by this Court. Hence, application is entitled for bail on principle of parity.

Considering this fact, I pass following order:
ORDER
i.
The Applicant be released on bail in Crime No. 817 of 2019 registered with Pimpri Police Station, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
ii.
The applicant shall attend the concerned police station as and when required.
iii.
The applicant shall not tamper with the evidence or attempt to influence or contact the complainant,
witnesses or any person concerned with the case. 6.
The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 7.
It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
