By this application, the Applicant is seeking regular bail in C.R.No. 56 of 2025 registered with Wagholi Police Station, Pune, for the offences punishable under Sections 420, 406, 409 r/w 34 of Indian Penal Code, 1860 (for short "IPC").

It is prosecution's case that the stay was granted by the Hon'ble Apex Court to sale the property situated at Wagholi. In spite of being aware of the said stay, land owner sold the said property to the first informant and others. It is alleged that the applicant acted as agent in the said transactions.

It is contention of learned Senior Counsel for the applicant that the applicant is behind bars for around one year. The applicant acted as

an agent in the said transactions. The applicant was not aware about the order passed by the Hon'ble Apex Court. The applicant has been cheated by the land owner i.e. accused No.1. The applicant has received Rs.14 lakhs as commission from the said transactions. To show his bonafide, the applicant has deposited the said amount before the Trial Court and requested to allow the application.

It is contention of learned APP that the Hon'ble Apex Court has stayed the sale transactions of the said land. In spite of that, accused No.1 sold the said land by defrauding the first informant and investors. The applicant has acted as a agent in the said transactions. The applicant has received commission out of the sale transactions. It shows his involvement in crime. If the applicant is released on bail, he may abscond or threaten prosecution witnesses. Hence, requested to reject the application. 5.

I have heard both learned counsel. Perused chargesheet and documents produced on record. No document is produced on record to show that applicant was aware about the stay order of Hon'ble Apex Court. It appears that accused No.1 was aware about the said order and he had approached before the committee to put his side. It is alleged that applicant has acted as an agent between the accused No.1 and first informant and other purchasers. To prove the case against the applicant, trial is required. The applicant is behind bars for around one year. The

applicant has no antecedents. Considering these facts, I pass following order.

ORDER

i.

The applicant be enlarged on bail in C.R.No. 56 of 2025 registered with Wagholi Police Station, Pune, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount.

ii.

The applicant shall attend the concerned police station as and when required.

iii.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case. 6.

The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 7.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
