Pursuant to the order passed in the morning session, Mr. Purushottam Tulshidas Gholve, the Applicant was produced before this Court by the authorities of Sindhudurg District Prison through VC. I have interacted with the Applicant. The Applicant had made the present Bail Application from Jail. He states that he has not been produced before the Trial Court on several occasions and, hence, he is unable to meet his counsel, who was also appointed through

(P.A.) 42_BA_4636_2025.doc the legal aid to represent him before the Trial Court. He further states that he was unaware that he he had been enlarged on bail subject to furnishing Rs.15,000/- with one or two local sureties.

During the interaction with the Applicant, it transpired that he is unable to arrange the said amount and is also unable to furnish the sureties as directed, owing to his economic condition. The Applicant has been languishing in jail from 17th October, 2024, despite the bail order having been passed by the Trial Court. In these circumstances, I am inclined to direct the Applicant to be released on cash bail in the sum of Rs.5,000/- for a period of four months from today, during which he shall furnish the sureties as directed by the Trial Court.

Ms. Sharma, learned counsel for the Applicant appointed through legal aid, submits that there are also other cases of which is may not be aware. The Applicant, Mr. Purushottam Tulshidas Gholve, has requested that Ms. Mallika

(P.A.) 42_BA_4636_2025.doc Sharma be directed to continue representing him as his legal aid counsel. He undertakes to provide the contact details of his relatives to Ms. Sharma to facilitated her to take necessary instructions and take steps. The Legal Aid Services is directed to reimburse Ms. Mallika Sharma, as per the applicable rules. 4.

Ms. Shakuntala Sharma was appointed by the Legal Aid Services to represent the present Applicant. Unfortunately, the legal aid given to the Applicant was inadequate, since he was not even informed about his enlargement on bail by the Trial Court. The Legal Aid Services Authority is directed to take cognizance of this and take appropriate steps in the regard.

With the aforesaid directions, Bail Application is disposed of.
