Both these applications are arising out of same crime, hence, I am deciding these applications by this common order : 2.

By these applications, the applicants are seeking regular bail in Crime No.307 of 2025 registered with Bhosari MIDC Police Station, District Pune, for the offences punishable under Sections 316(5), 318(4) Digitally signed by SHUBHADA SHANKAR KADAM Date:

2026.02.05 15:26:48 +0530 SHUBHADA SHANKAR KADAM and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is prosecution's case that the applicants have cheated the first informant of 6.5 crores in respect of company transactions. ₹ 4.

It is contention of the learned senior counsel for the applicants that after investigation, the cheated amount is mentioned as 1.40 crores. ₹ The applicants have not cheated the first informant. There is a dispute regarding IPR, which was sold to another firm. The applicants are behind bars for almost eight months. The applicants have no antecedents. Learned senior counsel further submitted that the applicants have deposited 50 lakhs before this Court to show their bona fides and requested to ₹ allow the applications.

It is contention of learned APP along with the learned counsel for the informant that the applicants have cheated the first informant. The applicants had assured that they would purchase the articles from the first informant's company, which they did not do, and instead entered into a joint venture with another company for the same product. If the applicants are released on bail, they may threaten the prosecution witnesses and requested to reject the applications.

I have heard all learned counsel, perused the charge-sheet and documents produced on record. Initially, the cheating amount was mentioned as more than 6 crores, but in the charge-sheet, it is ₹

mentioned as 1.40 crores. The dispute is regarding not keeping the ₹ promise given to the first informant's company and entering into a contract with another company. To show their bona fides, the applicants have deposited 50 lakhs before this Court. The applicants have no ₹ antecedents. The applicants are behind bars for more than eight months, it may take time to conclude the trial. Considering these facts, I pass the following order:

ORDER

(i) The applicants be enlarged on bail in Crime No.307 of 2025 registered with Bhosari MIDC Police Station, District Pune, on executing P.R.Bond in the sum of Rs.30,000/-each with one or two sureties in the like amount.

(ii) The applicants shall attend the concerned police station as and when required.

(iii) The applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The applications are allowed in the aforesaid terms and are accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its

own merits in accordance with law and uninfluenced by the observations made in this order.
