The Applicant seeks his release on bail in connection with C.R.No. 219 of 2022 dated 19th September 2022 registered with the Wagle Estate Police Station, Thane for the offences punishable under Sections 307, 326, 324, 323, 504, 506, 141, 143, 149 of the Indian Penal Code, 1860 ('IPC' for short) and Sections 4 and 25 of the Arms Act, 1959. 2.

At the very outset, Ms. Anamika Malhotra, learned APP representing the State in the matter, drew my attention to

order dated 11th September 2024 passed by this Court (Coram: N.J. Jamadar, J.) in the previous bail application of the Applicant, rejecting the same on merits. In the said order, this Court has lucidly enumerated facts and circumstances in the present C.R. and rejected the bail application after considering the material on record.

Mr. Waqar Pathan, learned counsel appearing for the Applicant, states that despite this Court's direction to the Trial Court in the bail application of the co-accused to expedite the trial, till date, even charges are not framed in the case. 2.

Learned counsel appearing for the Applicant further submits that the Applicant was not produced in the Trial Court for hearing on the past two dates.

Considering that this Court had rejected the earlier bail application as recent as September 2024 on merits, by a wellreasoned order, I not being inclined to enlarge the Applicant on bail, Mr. Pathan, learned counsel appearing for the

Applicant, sought permission to withdraw the present Bail Application.

Considering that the Applicant is in custody since 14th January 2023, albeit suffering a rejection of his bail application in September 2024, the Trial Court is requested to frame charges within the next 6 months. However, if charges are not framed within the next 6 months, the Applicant may renew his prayer for bail thereafter.

Permission to withdraw is granted with the aforesaid liberty.

Since the grievance of the Applicant is that he was not produced in the Trial Court for the past two dates, the Trial Court is requested to note the said grievance and pass appropriate orders.

The Applicant is at liberty to renew his prayer for bail even prior to period of 6 moths if the statement of the

Original Complainant is recorded by the Trial Court in the meantime.
