The Applicant is seeking regular bail in C.R. No. 8 of 2020 registered with Bundgarden Police Station, Pune for the offence punishable under Sections 201, 302 and 364 of Indian Penal Code. 2.

It is prosecution's case that on 05/01/2020, the applicant and co-accused kidnapped deceased Mr. Chandan Sheani and murdered him. 3.

It is contention of the learned counsel for the Applicant that coaccused Ajinkya Dhumal, against whom similar allegations are leveled, released on bail by this Court, the Applicant is entitled for bail on principle of parity and requested to allow the application. 4.

It is contention of learned APP that principle of parity will not

be applicable to the applicant as allegations against the applicant are serious. He hatched conspiracy to kill the deceased. The material produced on record shows involvement of the applicant in the crime, 5.

I have heard both the learned counsel. Perused charge-sheet and documents produced on record.

The role attributed to the co-accused Ajinkya Dhumal, who has been released on bail and Applicant are similar. Hence Applicant is entitled for bail on principle of parity.

Considering these facts, I pass following order:

ORDER

(i) The Applicant -Pritam Ramesh Ambre be enlarged on bail in Crime No. 8 of 2020 registered with Bundgarden Police Station, Pune on executing P.R. Bond of Rs.50,000/- on furnishing one or two sureties of the like amount.

(ii) The Applicant shall attend the concerned police station once in a month i.e. on first Monday of the month between 11.00 a.m. to 3.00 p.m. till framing of charge.

(iii) The applicant shall inform his latest place of residence and mobile number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Investigating Officer.

(iv) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

(v) The trial Court shall not be influenced by the observation made in this order and shall decide the matter on its own merits and in accordance with law.

The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.
