By way of this Application, the Applicant seeks his release on bail in connection with FIR No. 69 of 2025 dated 5th February 2025 registered with the Mankhurd Police Station for the offences punishable under Sections 8(c) and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 ("NDPS Act").

Presently, the Applicant is pressing only prayer clause (c), which is to permit him to appear for his 12th Standard examination.

Heard Ms. Krishma Joshi, learned counsel for the Applicant and Ms. Megha Bajoria, learned APP. 4.

Ms. Joshi submits that the Applicant is 18 years old, is presently studying in class 12th Standard and that his Board Examination is scheduled to commence from 12th February 2026. She has tendered the admit card issued to the Applicant.

By order dated 5th February 2026, Ms. Bajoria was requested to verify the details of the examination through the Investigating Officer. Today, she, on instructions, submits that the HSC examination of the Applicant is scheduled to be held from 10th February 2026 to 26th February 2026. 6.

Considering that the Applicant is desirous of appearing for the 12th Standard examination, I am inclined to enlarge the Applicant on interim bail only for the purpose of attending his examination and it is ordered as under:

ORDER

i) The Applicant be enlarged on interim bail; he is permitted to furnish cash bail of Rs. 10,000/- for his release. ii) The Applicant shall be released on interim bail from 9th February 2026 to 27th February 2026. He shall surrender himself before the jail authorities of the Mumbai Central Prison (Arthur Road Jail), without fail, at or before 3:00 p.m. on 27th February 2026;

iii) The Applicant shall inform his latest place of residence and mobile contact number immediately after being released and / or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the concerned Police Station; iv) The Applicant shall not tamper or attempt to influence or contact the complainant, witnesses or any person concerned with the case;

v) Any infraction of the aforesaid conditions shall entail cancellation of bail and he will be liable to be taken into custody immediately.
