By this application, the Applicant is seeking regular bail in C.R.No. 706 of 2025 registered with Yavat Police Station, Pune, for the offences punishable under Sections 110, 118(2), 118(1), 333, 115(2), 352, 351(2)(3), 3(5) and 324(4) of the Bharatiya Nyaya Sanhita, 2023 (for short "BNS Act).

It is prosecution's case that on 17.08.2025, at around 7:00 p.m. the applicant assaulted the first informant and her mother with iron rod with intention to kill them.

It is contention of learned counsel for the applicant that the

applicant is behind bars for more than eight months. There is no progress in trial. The applicant has no antecedents and requested to allow the application.

It is contention of learned APP along with learned counsel for the respondent No.2 that applicant brutally assaulted the first informant and her mother with iron rod with intention to kill them. The entire incident is captured in CCTV camera. There is a dispute going on between the applicant and first informant. If applicant released on bail, he may threaten first informant and prosecution witnesses and requested to reject the application.

I have heard both the learned counsel. Perused charge-sheet and documents produced on record. The applicant is behind bars for more than eight months. Investigation is completed. Charge-sheet has been filed. Considering these facts, I pass following order.

ORDER

i.

The applicant be enlarged on bail in C.R.No. 706 of 2025 registered with Yavat Police Station, Pune, on executing P.R.Bond of Rs. 30,000/- on furnishing one or two sureties in the like amount.

ii.

The applicant shall attend the concerned police station as and when required.

iii.

The applicant shall not tamper with the evidence or attempt to influence or contact the first informant, witnesses or any person concerned with the case. iv.

The applicant shall not enter in the jurisdiction of Yavat Police Station, except attending the Court dates till recording the evidence of first informant and injured witness.

The application is allowed in the aforesaid terms and is accordingly disposed of. All pending applications, if any, disposed of. 7.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
