This is an application for regular bail in connection with FIR No.394 of 2025 dated 6th November 2025 registered with the R.A.K. Marg Police Station for the offences punishable under Sections 109, 115(2), 352, 324 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 4 and 25 of the Arms Act, 1959 and Sections 37(1) and 135 of the Maharashtra Police Act, 1951.

The Applicant was arrested on 7th November 2025 and has been remanded to police custody till 15th November 2025. Admittedly, the charge-sheet has not been filed as on date.

Ms. Megha Bajoria, learned APP, on instructions, submits that the charge-sheet will be filed on or before 10th January 2026. In the meantime, Mr. Sachin Chandan, learned Counsel for the Applicant, submits that the Applicant, being a student of the 12th standard, is required to attend his college for submitting his EVS notebook, which is necessary to appear in the examination. In these circumstances, in order to avoid loss of one academic year, the Applicant is enlarged on Interim Bail for a period of two days only, to enable him to visit the college and submit the EVS notebook and other documents required to appear in the 12th standard final examination. 4.

The Applicant is accordingly enlarged on Interim Bail for a period of two days i.e. he will be released on 24th December 2025 at 9:00 a.m. and shall surrender back to the Arthur Road Prison on 26th December 2025 on or before 5:30 p.m.

During the period on which the Applicant is on Interim Bail, the Applicant shall report to the R.A.K. Marg Police Station, Mumbai at 9:00 a.m. on 25th December 2025.

Since Ms. Bajoria has stated that the charge-sheet will be filed on or before the 10th January 2026, Mr. Chandan seeks permission to withdraw the present Bail Application with liberty to file a fresh bail application before the Trial Court.

Permission to withdraw is granted with the aforesaid liberty.

The Bail Application is accordingly disposed of as withdrawn.
