Heard Mr. Ishan Paradkar, learned Advocate for the Applicant and Ms. Shilpa Talhar, learned APP for Respondent - State.

By the present Application, the Applicant has sought for the following substantive reliefs in prayer clause (a):- "a.
The Hon'ble Court may kindly allow the Application and enlarge the Applicant on bail in connection with CR No. 369 of 2023 registered with Khadak Police Station for the offences punishable under Sections 302 and 34 of Indian Penal Code, 3(25) of the Arms Act; 37(1)(3) and 135 of Maharashtra Police Act 3(1)(ii), 3(2) and 3(4) of Maharashtra Control of Organized Crime Act, 1999:"

Mr. Ishan Paradkar, learned Advocate for the Applicant, refers to the earlier order of this Court, which refers to the Ballistic Report and submits that the Respondent has not placed the Ballistic Report on record till date.

Ms. Shilpa Talhar, learned APP for Respondent - State, on instructions from the Investigating Officer, Khadak, Police Station, Pune, submits that the Ballistic Report is expected to be received within 4 weeks from today.

In view of the statement made by Ms. Shilpa Talhar, learned APP for Respondent - State, Mr. Ishan Paradkar, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw this Bail Application, with liberty to file a fresh Bail Application before the Trial Court upon the Ballistic Report being placed on record by the prosecution. This request, made by Mr. Ishan Paradkar, learned Advocate for the Applicant, is not opposed by Ms. Shilpa Talhar, learned APP for Respondent - State.

In view of the statement made by Mr. Ishan Paradkar, leave is granted to withdraw the present Bail Application with liberty as prayed. In the event a fresh Bail Application is filed before the Trial Court, the same be considered on its own merits and in accordance with law.

Criminal Bail Application No. 4813 of 2025 is disposed of as withdrawn.
