15th JUNE, 2026 1) The instant Application seeks release of the Applicant on bail in C.R.No.214/2025 registered with Kashimira Police Station, Mira-Bhayander, Vasai-Virar Police Commissionerate for commission of the offences punishable under Sections 8(c), 22(k) and 29 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985.

2) Heard Mr. Shaikh, learned Counsel for the Applicant and Ms. Shinde, learned APP for the Respondent.

3) As projected from the record, the prosecution case is that on 17.05.2025, the informant Mr.Vinod Awale, PHC, his superior and other police personnel were patrolling within their jurisdiction. At about 00.55 hours, when they came near Arshdeep Building, Mira Road (East), Accused No.1 Rohitkumar Singh was present there. His movements were suspicious. Therefore, police apprehended him and conducted his person search following the mandates of NDPS Act. M.D. Mephedron powder weighing 52.7 grams was

found in his possession. It was seized. As alleged, the Applicant had given the said contraband to A-1 to sell the same. The Applicant was present at the spot when the A-1 was apprehended by the police. However, he fled away. In the backdrop, said crime came to be registered. His Bail Application has been rejected by the Sessions Court.

4) Nevertheless, there is no mention in the FIR that the police had seen the Applicant at the spot nor that the Applicant fled away on seeing the police. There is no independent material showing that the Applicant had given the contraband to A-1 to sell the same. The Applicant has been arrested only on the basis of the information provided by the A-1. No contraband has been seized from the Applicant. The Applicant has no criminal antecedents. Therefore, whether the Applicant is involved in the present crime or not, is a question of trial. The investigation is over. Further detention of the Applicant will not serve any purpose. The Applicant is not likely to abscond and tamper with the prosecution evidence.

5) In view thereof, the Applicant is entitled for bail. Hence, following Order :- (i) Applicant - Karan Uday Singh be released on bail in C.R.No.214/2025 registered with Kashimira Police Station, Mira-Bhayander, Vasai-Virar Police Commissionerate for the offences punishable under Sections 8(c), 22(k) and 29 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, on his executing P.R. Bond in the sum of Rs.50,000/- with one or two sureties in the like amount.

(ii) The Applicant shall mark his attendance at Kashimira Police Station, Mira-Bhayander, Vasai-Virar Police Commissionerate on 1st day of each calender month between 11:00 a.m. to 2:00 p.m. till completion of the trial. (iii) The Applicant shall regularly attend the proceedings before the jurisdictional Court unless exempted by the said Court, for the reasons to be recorded in writing. (iv) The Applicant shall not tamper with the prosecution evidence and shall not directly or indirectly influence upon the prosecution witnesses to prevent them from deposing against him.

(v) On being released from jail, the Applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.

(vi) By way of abundant caution, it is clarified that the observations made hereinabove are confined for the purpose of determination to the entitlement for bail and they may not be construed as an expression of opinion on the guilt or otherwise of the Applicant and the trial Court shall not be influenced by any of the observations made hereinabove.
