Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No. 173/2024 registered with Upanagar Police Station, District Nashik, for the offences punishable under Sections 302, 120B, 144, 148, 149, 504 of the Indian Penal Code, 1860 and under Section 135 of Bombay Police Act and under Sections 4 & 25 of Arms Act, 1959. 3.
It is prosecution's case that on 07/05/2024, friend of the first informant was murdered by Applicant and co-accused by assaulting him with sharp weapon.

It is contention of learned counsel for the Applicant that Applicant is behind around three years, yet charge is not framed. The coaccused, having similar allegations, has been released on bail by this Court. and requested to allow the Application.

It is contention of learned APP that Applicant and co-accused assaulted the deceased. The incident is witnessed by first informant. There are specific allegations against the Applicant. He submits that if Applicant released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the Application.

I have heard both learned counsel. Perused charge-sheet and documents produced on record.

The co-accused Sumit Jadhav, against whom similar allegations are leveled like the Applicant, has been released on bail by this Court [Coram: Ashwin Bhobe, J.]. Hence, Applicant is entitle for bail on the principle of parity.

Considering these facts, I pass following order.
ORDER
(i) The Applicant- Prem Santosh Dhengle @ Takkya be released on bail in Crime No. 173/2024 registered with Upanagar Police Station, District Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.
(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
(iii) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.
(v) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.)
