By this application, the applicant is seeking regular bail in Crime No. 568 of 2025 registered with Ambad Police Station, District Nashik, for the offences punishable under 64(1), 75, 77, 79, 107, 108, 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 4, 8 and 12 of Protection of Children from Sexual Offences Act, 2012 and Section 66(e) and 67 of the Information and Technology Act. 2.

It is prosecution's case that the applicant and co-accused mentally and physically harassed the daughter of the first informant. It is SHUBHADA SHANKAR KADAM alleged that the applicant sent photographs with deceased to accused No.2 SHUBHADA SHANKAR KADAM Date: 2026.03.12 10:36:45 +0530 through the account of the deceased. Accused No.2 sent the said

photographs to accused No.1, who was allegedly the boyfriend of the deceased and mentally harassed her. It is alleged that due to mental harassment, the deceased committed suicide by hanging herself. 3.

It is contention of learned counsel for the applicant that the applicant is a close relative of the deceased. The applicant is a student. He is behind bars for around five months. Investigation is completed and charge sheet has been filed. The applicant has no antecedents. Hence, requested to allow the application.

It is contention of the learned APP along with learned counsel for respondent No.2 that WhatsApp chats between the applicant and the deceased show that the applicant was threatening the deceased. The applicant uploaded photographs with deceased through her Instagram account and due to those photographs, the incident occurred. It shows active involvement of the applicant in the crime. Hence, requested to reject the application.

I have heard both learned counsel, perused charge sheet and documents produced on record. The applicant is a student and he has no antecedents. He is behind bars for around five months. If he remains behind bars, his academic career will be ruined. Considering these facts, I pass the following order.

ORDER

(i) The applicant be enlarged on bail in Crime No. 568 of 2025 registered with Ambad Police Station, District Nashik, on executing P.R.Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

(ii) The applicant shall attend the concerned police station as and when required.

(iii) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the case on its own merits in accordance with law and uninfluenced by the observations made in this order.
