Heard the learned counsel appearing for the applicant.

By this application, the applicant seeks extraordinary relief of anticipatory bail in connection with Crime No. 521/2025 registered with Police Station, Balapur, Dist. Akola for the offence punishable under Section 376 of the Indian Penal Code.

The contention is that, there is a property dispute between the applicant and the husband of the victim. A false report has been lodged against the applicant alleging commission of rape on the victim who is the wife of Panjabrao (complainant). It is also contended that after the incident, another report was filed by Panjabrao wherein, no incident of rape was mentioned. However,

2 43 aba6.26.odt on an application filed by the complainant under Section 156(3) of the Code of Criminal Procedure, the aforesaid offence came to be registered against the applicant under the direction of the learned Magistrate.

Issue notice to the non-applicant-State as well as the newly added non-applicant/victim, returnable on 20.01.2026.

Considering the submissions and the fact that in the earlier complaint lodged before the police, no incident of rape was reported by the husband of the victim, a case is made out for grant of interim protection.

Till the next date, in the event of arrest of applicant - Ajabrao Uttamrao Janjal in connection with Crime No. 521/2025 registered with Police Station, Balapur, Dist. Akola for the offence punishable under Section 376 of the Indian Penal Code, he be released on bail on furnishing a PR bond of Rs.25,000/- (Rupees Twenty Five thousand only) with one solvent surety in the like amount. 9.

The applicant shall attend Police Station, Balapur, Dist. Akola on 12th, 15th and 19th January, 2026 between 10.00 am and 12.00 pm and cooperate with the investigation.
