This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.260 of 2024 registered with Shivaji Nagar Police Station, Pune, for the offence punishable under Sections 74 and 78(2) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution, the Applicant has touched the First Informant twice on a Metro Station.

Mr. Chandrashekhar Anantpure, learned Counsel appearing for the Applicant points out the affidavit of Ms. Kirtee Shailendra Jogdeo, mother of the Applicant where she has stated that in the year 2015, the Applicant was dignosed with Borderline Intellectual Functioning Disorder and thereafter the Applicant was also detected with Autism Spectrum Disorder and Paranoid Schizophrenia. A Certificate dated 29th July 2025 issued by Zorbawellness and Therapy Private Limited is also annexed to the said affidavit wherein it is stated that the Applicant is in Wellness Centre since 1st February 2025. Thus, although there is substance in the complaint filed by the First Informant, however, the First Informant may not be aware about the medical condition of the Applicant.

A learned Single Judge has protected the Applicant by order dated 20th January 2025. Learned Counsel submitted that as per the direction of the learned Single Judge, the Applicant has

attended the concerned Police Station from 27th January 2025 to 29th January 2025.

Accordingly, in the facts and circumstances, case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Varoonraj Shailendra Jogdeo in connection with C.R. No.260 of 2024 registered with the Shivaji Nagar Police Station, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.5,000/- with one or two sureties in the like amount.

(b) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(c) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade

such a person from disclosing the facts to the Court or to any Police personnel.

(d) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(e) The Applicant shall not leave India without prior permission of the Court.
